Agreement to terms

By accessing or using the website at www.thesiteguy.ca or purchasing any services from The Site Guy (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

Services

The Site Guy provides web design, development, AI automation, CRM integration, and related digital services for Canadian businesses. Our services include but are not limited to: website design and development, SEO and Google rankings, AI customer chatbots, review generation systems, online booking and scheduling, CRM and lead management, blog and CMS setup, hosting, and ongoing support and updates.

Service details, features, and pricing are described on our Services and Pricing pages and may be updated from time to time.

Billing & payments

  • All prices are listed in Canadian Dollars (CAD) unless otherwise stated.
  • Plans are billed on a recurring month-to-month basis by default. An annual billing option is also available, billed at 10× the monthly rate (effectively two months free), and renews yearly until cancelled. There are no forced long-term contracts.
  • There is no setup fee. The build, onboarding, configuration, and launch are included in the plan.
  • Payments are processed securely through Stripe. We do not store your payment card information.
  • You may upgrade or downgrade your plan at any time without penalty.

Cancellation & refunds

You may cancel your monthly subscription at any time. Upon cancellation:

  • Your service will remain active until the end of the current billing period.
  • You retain full ownership of your website and all content we created for you.
  • 30-day money-back guarantee: if you are not satisfied within the first 30 days of your initial purchase, you may request a full refund of your first monthly (or annual) payment.
  • After the initial 30-day window, monthly and annual subscription payments already processed are non-refundable.

Ownership & intellectual property

  • Your content: you retain full ownership of all website content, copy, images, and assets you provide or that we create specifically for your project.
  • Our tools & code: we retain ownership of proprietary tools, frameworks, and reusable code components used across client projects. You receive a perpetual license to use them as part of your delivered website.
  • Portfolio rights: we may showcase your completed project in our portfolio unless you request otherwise in writing.

Client responsibilities

To ensure timely delivery and quality results, you agree to:

  • Provide requested content, assets, and feedback in a timely manner.
  • Ensure that all content you provide does not infringe on any third-party rights.
  • Not use our services for any unlawful or prohibited purpose.
  • Maintain the security of any account credentials we provide.

Service availability

We strive to keep your website and services running smoothly. However, we do not guarantee 100% uptime. Hosting uptime is subject to our hosting provider (Vercel) and third-party service availability. We are not liable for downtime caused by third-party providers, scheduled maintenance, or circumstances beyond our control.

Limitation of liability

To the fullest extent permitted by Canadian law, The Site Guy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Disclaimer

Our services are provided “as is” and “as available.” While we strive for the highest quality, we do not guarantee specific business results, search engine rankings, or revenue outcomes from the websites or systems we build. Any projections or examples shared are for illustrative purposes only.

Governing law

These Terms of Service are governed by and construed in accordance with the laws of Canada and the province in which we operate. Any disputes arising from these terms shall be resolved through good-faith negotiation, and if necessary, through the courts of competent jurisdiction in Canada.

Changes to these terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
